<!-- I'm thinking of having this page be handled as a Tier-1 Theme article -->
Digital storefront shutdowns, or the practice of discontinuing online storefronts for consoles and other devices, has become increasingly common. This often results in the removal of games exclusive to these platforms, such as Pokémon Picross for the Nintendo 3DS, Battlezone for the Xbox 360, and the PlayStation Portable (PSP) remasters of classic Final Fantasy titles. These shutdowns leave many games inaccessible to new users, raising concerns over digital preservation and the long-term viable usage of digital-only content. Especially as more recent closures mean that access to games that are reliant on servers end up being affected by these storefront closures.
Wii Shop Channel (2006–2019)
The Wii Shop Channel, launched in 2006, allowed Nintendo Wii users to purchase and download a variety of content, including Virtual Console games, WiiWare titles, and other downloadable content. Users could load their accounts with Wii Points, a virtual currency, to make purchases. This system offered access to a diverse library of classic games and indie releases, however the service was officially shut down in 2019, and with it, many of the games and content became inaccessible.
Wii U/3DS eShops (2012–2023)<!-- Consider discussing making a new post for this -->
Launched in November 2012, the Nintendo eShop for Wii U and 3DS was Nintendo's 2nd major digital storefront. Because of this, the devices can no longer reach the storefront to download purchased games or use the features that were advertised. Models such as (but not limited to) the Leapster, Leapster Explorer, My Own Story Time Pad, My Own Leaptop, Crammer, Didj, and Leapster 2 still function offline with any content that was already stored on them. However, any games that were bought but not downloaded to the device before the shutdown are now inaccessible. The software was also necessary for connecting the device to a PC, managing its content, transferring user files, and sending messages to and from your child. .
Attempted storefront shutdowns
PlayStation 3/PSVita storefronts
In 2021, Sony attempted to shut down the storefronts of 3 of their legacy consoles, the PSP, PSVita, and PS3. Unlike the PSP however, backlash from the community made it so consumers currently remain capable of purchasing and downloading new digital copies of PS3 titles, so long as the release has not been removed from the platform storefront. The PS3 is to be the final home console of the 7th console generation and the PSVita as the expected final portable console of the 8th console generation to retain access to its manufacturer's storefronts. <!-- It is a gamble to see if the Nintendo Switch will see support from Nintendo for more than 5 years at this point. -->
Nearly 20 years later, it was shut down, although unlike most other storefront closures, users could still reinstall games they purchased as long as publishers did not have their games delisted prior to the shutdown or later, so titles such as World Gone Sour published by Capcom or Assassin's Creed 3 published by Ubisoft are entirely unplayable <!-- I want more examples, I expect that Ubisoft pulled something like this.
https://delistedgames.com/xbox-360-games/ --> unless consumers happened to still have had the game installed to their consoles, or bought a disc if the title received an official physical release.

Stadia (2019–2023)
Launched in November 2019, Stadia was the first cloud gaming service with a storefront. Its storefront was abruptly shut down for users in September 2022 without notice, and the entire service shuttered in 2023. As the shutdown of the service meant users who made purchases on the platform could not play the products they paid for, Google refunded purchases of both hardware and software for the platform, however many platform-exclusive titles<!-- Someone archive this tweet so users can read it without potentially needing an account --> were never re-released,. These devices are no longer able to connect to the storefront to access bought games and use advertised features. The devices such as (but not limited to) the Leapster, Leapster Explorer, My Own Story Time Pad, My Own Leaptop, Crammer, Didj & Leapster2 continue to work as-is offline with previously downloaded content however any titles purchased and not downloaded to the device itself prior to being discontinued are no longer accessible. The software was also required to connect the device to your PC and manage content on the device including access/transfer user content and sending messages to and from your child .

Consumer impact summary
NextGenTV has had privacy concerns over internet based viewer metrics/analytics and targeted advertising, voiced by FCC commissioner Geoffrey Starks in 2020. More importantly, NextGenTV marked the introduction of Digital rights management and encryption to freely available television airwaves.

The authority for encryption in ATSC 3.0 is called A3SA. According to a article on Techhive, restrictions that could be imposed by A3SA's DRM might include:

*Blocking or setting expiry dates on recordings
*Blocking remote access of tuners
*Always-on internet being required for viewing/streaming/playback
*Pairing recordings to the tuner it was recorded from
*"Blessing" devices that pass the A3SA's DRM certification and licensing program
The Techhive article also describes that implementation of DRM could increase the cost of tuners due to the required licensing and certification programs on vendors.

On certified devices, it was also discovered by Lon Seidman that tuner decryption certificates can expire after 10 to 30 years.
Incidents
Many major US ATSC 3.0 pilot stations started encrypting their broadcasts in 2023, locking out users of all pre-certification ATSC 3.0 tuners without decryption support. This has led to some resource websites like rabbitears.info to become concerned about their future providing information on channels due to encryption becoming more widespread. They warn the site may be unable to operate as the tools for analysis of channels become inoperable on encrypted channels.

In cases where encrypted channels were able to be decrypted using certified tuners, it has been reported an active internet connection is required to tune or switch between encrypted channels.

LG has also encountered patent issues trying to incorporate tuners into their TVs, which resulted in a dispute with Constellation Design Inc. that ended ATSC 3.0 tuner support in new LG televisions as of September 2023.
SiliconDust of HDHomeRun has engaged in official correspondence with the Federal Communications Commission (FCC) in response to Pearl TV (ATSC 3.0) with regards to "Authorizing the Permissive Use of the “Next Generation” Broadcast Television Standard (GN Docket No. 16-142)" pointing out Pearl TV is acting as a gatekeeper by deciding which tuners to allow and not allow even after being "certified" for NextGenTV ATSC 3.0 as well as making mention that strict exclusive use of (google) widevine prevents popular devices such as Roku, Xbox, Apple TV, iPhone, iPad, Windows, or Mac from ever accessing the encrypted channels. At which the two responded back and forth where Pearl TV attempted to make claim that SiliconDust is using a blacklisted chip. Pearl also made claim that SiliconDust must have a Widevine CDM license. To which SiliconDust responded claiming Pearl continues to push false narratives. They point out they are "not required or expected to have the Level 1 CDM license described by Pearl" as well as stating that the "SoC part used in a video gateway device [the blacklisted chip], is not relevant in any way to viewers accessing ATSC 3.0 content." In follow-up to this incident, Nicholas J Kelsey – President of Silicondust met with the FCC where he goes over in detail how the broadcast industry is attempting to use ATSC 3.0 DRM to illegally limit access to public airwaves, "The TV receiver market is being regulated by the private broadcast industry (a different industry)" by acting as gatekeeper, Stifling innovation, having "secret A3SA rules" as well as many other key points in relation to these issues. (*It should be noted that discussion in regards to the A3SA specifications and rules are forbidden from being referenced in the filings due to NDAs).

Pearl TV accuses SiliconDust HDHomeRun devices of using a chip manufactured by Chinese HiSilicon, which is blacklisted by the US government and uses that as their reasoning to not approve SiliconDust HDHomeRun for DRM certification suggests that any component from a blacklisted company violates the industry’s secret, non-disclosable rules concerning decryption. However, the SiliconDust devices have FCC certification & approval for sale in the USA indicating broadcast networks are trying to regulate tuner devices despite private industry having no authority to do so. It is also worth noting, A3SA & Pearl's use of "Selectively enforcing this rule" is based on the fact that their own DRM certified device (Converter X1 by GTMedia (A Chinese company)) contains a similar chip that is also blacklisted by the US government. Moreover, GTMedia devices were shipped running an outdated Android OS with known security vulnerabilities and required side-loading of all apps due to the absence of the Google Play Store, further compromising user safety.

However, the SiliconDust devices have FCC certification & approval for sale in the USA.
This has led to some resource websites like rabbitears.info to become concerned about their future providing information on channels due to encryption becoming more widespread. They warn the site may be unable to operate as the tools for analysis of channels become inoperable on encrypted channels.
Pearl TV accuses SiliconDust HDHomeRun devices of using a chip manufactured by HiSilicon which is blacklisted by the US government and uses that as their reasoning to not approve SiliconDust HDHomeRun for DRM certification suggesting that any component from a blacklisted company violates the industry’s secret, non-disclosable rules concerning decryption. However, the SiliconDust devices have FCC certification & approval for sale in the USA. It is also worth noting, A3SA & Pearl's use of "Selectively enforcing this rule" is based on the fact that their own DRM certified device (Converter X1 by GTMedia (A Chinese company)) contains a similar chip that is also blacklisted by the US government. On top of that, those devices were shipped running the "Android operating system that was four years out of date containing many known security vulnerabilities that puts consumers at risk", as well as the requirement of side-loading of all apps because it did not have the Google Play Store which opens the door to additional vulnerabilities.
The Crew shutdown
One of the most significant consumer protection issues surrounding Ubisoft in recent years relates to the 2014 game The Crew. In late 2023, Ubisoft announced the shutdown of the online services for The Crew, making the game unplayable entirely, even the single-player content. The decision to decommission the game's servers was controversial, as Ubisoft retroactively altered the terms of sale. On January 15, 2024, Ubisoft's director of subscriptions, Philippe Tremblay, was interviewed by gamesindustry.biz. That's the consumer shift that needs to happen. They got comfortable not owning their CD collection or DVD collection. That's a transformation that's been a bit slower to happen [in games]. As gamers grow comfortable in that aspect… you don't lose your progress. If you resume your game at another time, your progress file is still there. That's not been deleted. You don't lose what you've built in the game or your engagement with the game. So it's about feeling comfortable with not owning your game."</blockquote>
GDPR Complaint
On April 24 2025, noyb (a European non-profit organisation for digital rights) filed a GDPR complaint to the Austrian data protection authority (DSB) against Ubisoft for forcing its customers to connect to the internet every time a single player game is launched, thereby collecting data on gaming behaviour. This collection of data is alleged to be an infringement of Article 6(1) of the GDPR.

Noyb's official statement:
<blockquote>Complaint filed in Austria. noyb has therefore filed a GDPR complaint with the Austrian data protection authority (DSB). We request the DSB to declare that Ubisoft infringed Article 6(1) GDPR with its processing of personal data without a valid legal basis. In addition, we request that Ubisoft deletes all personal information by the complainant that has been processed without a valid legal basis – and that the company ceases further unlawful processing. Last but not least, we suggest that the data protection authority impose an administrative fine. Based on Ubisoft’s turnover of more than € 2 billion, the data protection authority could issue a fine of up to € 92 million.(“Like to Play Alone? Ubisoft Is Still Watching You!,” 2025)</blockquote>

According to noyb there is no valid and legal reason to collect such data "Under Article 6(1) GDPR, there seems to be no valid legal basis to randomly collect such user data" (“Like to Play Alone? Ubisoft Is Still Watching You!,” 2025).
During this interview, Tremblay made the following comment on ownership:<blockquote>"One of the things we saw is that gamers are used to, a little bit like DVD, having and owning their games.
In California, a gift certificate is not allowed to expire.<!-- could not find copy of court document, only the polygon report -->
