The Australian Competition and Consumer Commission investigated and identified that the statement was likely misleading as customers were not in fact facing any immediate disconnection of thier existing services. The ACCC initiated proceedings in the Federal Court who found that the statement was in fact deceptive and ordered Optus to pay $6.4 Million in penalties.
