The Osmo Pocket 3 camera requires the owner to use the DJI Mimo smartphone app. The camera can only be used 5 times without using the app for "activation". After 5 times the usage of the camera is impossible unless the DJI Mimo app is installed and used to "activate" the camera.<ref>"''Osmo Pocket 3 requires activation through the DJI Mimo App''" in section "''Activating the camera''" of the Cameras Beginner's Guide, Retrieved on March 17, 2026. Furthermore, activating the camera via the DJI Mimo app, requires users to agree to the DJI products terms of use, which include both binding arbitration and a class action waiver. <ref>{{Cite web |date=2024-09-03 |title=DJI products terms of use |url=https://www.dji.com/en/terms |url-status=live |archive-url=https://web.archive.org/web/20250403035327/https://www.dji.com/terms |archive-date=2025-04-03 |access-date=2025-04-19 |website=DJI official website}}</ref>

This is an anti-consumer practice that forces users to install and use proprietary software on their mobile devices (see [[Forced app download]]), potentially giving up their personal data and depriving them of their right to hold DJI accountable in a court of law.

The DJI Osmo Pocket 3 is a 3-axis gimbal camera released in October 2023 that can't be used until the owner installs the DJI Mimo smartphone app & completes a mandatory activation process.[1][2] That activation forces acceptance of DJI's terms of use, which include binding arbitration & a class action waiver.[3] The Mimo app collects location data, device identifiers, & user content;[4] on Android, the app isn't available through Google Play & users must sideload an APK directly from DJI's website.[5]

Incidents

Forced app activation

Despite having its own 2-inch OLED touchscreen, 1-inch CMOS sensor, microSD storage, & 1,300 mAh battery, the Osmo Pocket 3 ships as a locked device.[2] DJI's official documentation states that the camera "requires activation through the DJI Mimo App" before first use.[1] DJI's activation instructions require a smartphone with Bluetooth & Wi-Fi enabled to connect to the camera through the Mimo app.[6]

The camera allows the owner to skip the activation prompt five times. After the fifth skip, the device locks & requires activation before any further use.[7] DJI's "Activating Your Handheld Products" support page documents the same 5-trial mechanism for the Osmo Action series.[6]

This isn't unique to the Pocket 3. DJI's activation page lists the Osmo Action series, Osmo Mobile series, Osmo Nano, & Osmo 360 as also requiring Mimo-based activation.[6] By contrast, the competing FeiyuTech Pocket 3 is "ready to go straight out of the box without the need for an app."[7]

DJI Mimo app data collection

The DJI Mimo app required for activation collects data that Apple's App Store privacy label categorizes as "used to track you": contact information & device identifiers.[4] The app also collects coarse location data, user-generated content (photos, videos, audio), usage data, & diagnostics.[4] Apple's listing notes the app "may use your location even when it isn't open."[4]

A 2020 analysis by cybersecurity firm River Loop Security found that the Mimo app integrated a third-party SDK from MobTech, a Chinese analytics company, which transmitted device information including brand, model, display size, OS version, carrier data, & geolocation to MobTech's servers without encryption.[8] River Loop concluded that "even without user consent, the DJI Mimo app sends sensitive information via unsecured means to third-party servers, where the Terms of Use Agreement supports cooperation with the Chinese Government."[8] The analysis also found weak AES-128 ECB encryption with deterministic key construction, making intercepted data recoverable by "a moderately talented attacker."[8]

DJI Mimo isn't available through Google Play on Android.[9] DJI instructs Android users to download & install an APK file directly from their website instead, bypassing Google Play's app review process.[5]

Binding arbitration & class action waiver

Activating the camera through DJI Mimo requires agreeing to DJI's Product Terms of Use (last updated December 22, 2025), which state in their preamble that "all disputes between you and DJI Entities will be resolved by binding arbitration."[3] Section 11 contains the full arbitration framework, administered under the Federal Arbitration Act & governed by American Arbitration Association (AAA) rules.[3]

Section 11.6 bars collective legal action: "CLASS ACTION LAWSUITS, CLASS-WIDE ARBITRATIONS, PRIVATE ATTORNEY GENERAL ACTIONS... ARE NOT ALLOWED."[3]

DJI's terms don't offer a general opt-out from the arbitration clause for new users. The only opt-out mechanism applies to future modifications of the clause: users can reject changes within 30 days, but doing so terminates their DJI account, and the prior version of the arbitration clause survives.[3] Because the camera requires activation through a DJI account,[1] account termination renders the hardware dependent on reacceptance of the terms.
