2017 Data Breach

Through a non-publicized report sent by PSCU to its bank members, it was discovered that between October 25, 2016 till January 19, an un-named restaurant retailer was involved in a data breach leaking 355,000 customers debit and credit card information.[2] Arby’s became aware of the situation in January after being informed by industry partners and PSCU, resulting in an investigation with law enforcement and security experts that determined malware was used to target Arby’s point of sales systems during the attack.[3]

Arby’s didn’t immediately disclose the breach until February due to a request from the FBI, however in a public statement from a spokesman announced that the malware has been removed, and it’s collaborating with law enforcement, however the company refused to give explicit details on the exact date of the attack.[4][5]

“Arby’s Restaurant Group, Inc. (ARG) was recently provided with information that prompted it to launch an investigation of its payment card systems. Upon learning of the incident, ARG immediately notified law enforcement and enlisted the expertise of leading security experts, including Mandiant. While the investigation is ongoing, ARG quickly took measures to contain this incident and eradicate the malware from systems at restaurants that were impacted.” [6][7]

On March 2, 2017, a lawsuit was filed against Arby’s for failure to implement security practices, however the case reached a $2 million settlement on June 6, 2019.[8][9]

Providing less meat than advertised

Joseph Alongi filed a class action lawsuits against Arby's on September 5, 2023 over the company advertisement misrepresenting the amount of meat contents, usually resulting in getting half the meat as advertised. [10][11] In response, Arby's filed an motion to dismiss the case, claiming the photos provided "amounted to non-actionable puffery", however the dismissal was denied on September 29, 2025, stating it doesn't contain "subject statements of opinion"..[12] The case is still evolving as of January 2026.[13]
