In May of 2025, Nintendo changed their Nintendo Account User Agreement[1] and Privacy Policy[2] and sent an email out to all users. A photo copy of the email sent to users registered in America can be viewed below.

In this email Nintendo let users know that by continuing to use any Nintendo Account, including keeping the account opened affirms that you agree to the changes and if you do not agree to the changes "you must cancel your Nintendo Account Immediately".

Nintendo Account User Agreement (EULA)[edit | edit source]

May of 2025, Nintendo publishes a summary of the changes to the Nintendo Account User Agreement[3]. These changes highlight section 16 where forced arbitration will be used to resolve disputes.

What the summary of the changes doesn't bother to mention is that part of section 16 also forces users to waive their right to join a class action lawsuit against Nintendo.

User's account inaccessible[edit | edit source]

Consumers are permanently locked out of their Nintendo account until they accept the new terms and conditions. It is reported that some consumers are unable accept the new conditions due to a technical oversight by Nintendo, rendering affected accounts inaccessible.[citation needed]

The email communication system maintained by Nintendo has historically had problems.[citation needed] With this new change, children's accounts are being told to make their parent accept the new policy. While this is a good idea, the emails are not going through or accounts with no email or parents are still being asked to send an email to nowhere, making these accounts inaccessible and game data locked until a fix is issued.
