NVWB response to the ruling in favor of KNMI

Het KNMI heeft het kort geding gewonnen tegen de commerciële weerapps als Weerplaza en Buienradar. Wat betekent deze uitspraak nu voor de commerciële weerapps?

Het is natuurlijk een teleurstellende uitspraak, want we hebben dit kort geding niet voor niets aangespannen. Het is natuurlijk een oneerlijk speelveld waarbij KNMI een app kan maken met belastinggeld en waar wij ons verdienmodel daarop baseren. En ik denk ook dat we elkaar hard nodig hebben. Ik denk dat we de innovatie en het bereik van de commerciële sector ook nodig hebben om alle consumenten in Nederland te bereiken. We vinden nog steeds dat we hierin een punt hebben. De rechter heeft natuurlijk anders gesproken, maar we zien ook wel dat de rechter eigenlijk niet echt inhoudelijk heeft gesproken. De rechter heeft vooral gezegd, ik kan niet op de stoel van de wetgever gaan zitten. Wetgeving die nog in de maak is, daar kan ik niks over zeggen. En over bijvoorbeeld de locatiespecifieke gegevens die er al een tijdje in zitten in de app van het KNMI, dat heeft geen urgent, geen spoedeisend karakter. Dus daar kan ik in een kort geding niets zo over zeggen. Dus waar ons de teleurstelling vooral zit, is dat er inhoudelijk eigenlijk geen uitspraak is gedaan. En dat we dus moeten overwegen, hoe moeten we dan inhoudelijk wel een uitspraak krijgen om duidelijkheid te krijgen, wat er nu eigenlijk in die wet staat.

Maar het gaat jullie dan ook vooral om dat de KNMI met zijn app lokale weersvoorspellingen kan geven, wat jullie ook doen?

Ja precies. Kijk, het KNMI, en daar zit een beetje de crux, doet dat in het kader van haar publieke taak. En die herkennen wij ook, de publieke taak van het KNMI is een algemeen bericht voor de samenleving en het waarschuwen van het publiek voor extreem weer. We vinden dat ook heel belangrijk, we moeten het KNMI ook zeker kunnen doen. Maar dat betekent niet dat je het weer van alle dag op postcode niveau hoeft te zetten in een app, waardoor je concureert met de markt. Daar is het KNMI gewoon niet voor bedoeld. Daar zit eigenlijk, zeg maar, ons verschil van inzicht met het KNMI. In plaats van zou er veel liever met het KNMI samenwerken om te zeggen, hoe kunnen wij nou samen de beste waarschuwing voor de Nederlandse burger creëren en dat samen met zo groot mogelijk bereik in de samenleving verspreiden.

Maar wat worden jullie vervolgstappen dan?

Nou ja, goed, wij zullen, zeg maar, met de collega-weerbedrijven ook nog afstemmen wat we hiermee willen doen. Er zijn natuurlijk een aantal routes, we zouden kunnen kijken, dit is een kort geding. Ja, moeten we toch de rechter vragen om daar nog eens op een andere manier naar te kijken. Of ja, toch ook een beroep doen op de politiek om goed te kijken, van ja, is dit nu wel wat we willen? Willen we wel dat het KNMI belastinggeld spendeert aan activiteiten die ook de markt invult, en ook heel goed invult? En vinden we dan wel logisch dat een overheidsinstallatie concurreert met de markt?

Toch, denk ik dan ook, is het uiteindelijk dan niet een best domme zet geweest om dit kort geding te starten, want dat is allemaal gratis reclame geweest voor de nieuwe app van het KNMI. En die app staat ook hoog in de app-lijstjes op dit moment.

Dat is zeker, gelukkig is er alweer een stukje gezakt, maar ja, dat is natuurlijk altijd een afweging. Als je een kort geding start, dan is er in ons geval ook een stuk publiciteit omheen. Daar hebben wij niet zelf voor gekozen. Maar goed, uiteindelijk moeten we ook wel duidelijk uitgeven over waarom we zo iets doen. Dus vinden we het ook wel onze verantwoording om dat uit te leggen via de media. Maar inderdaad, ik verwacht nog wel een flesje wijn van het KNMI voor deze goede campagne die we hebben gedaan.

What does this ruling now mean for commercial weather apps?

It's obviously a disappointing ruling, because we filed this summary proceedings for a reason. It's obviously an unfair playing field where KNMI can make an app with taxpayer money and where we base our revenue model on that. And I also think we desperately need each other. I think we also need the innovation and reach of the commercial sector to reach all consumers in the Netherlands. We still think we have a point in this. Of course, the judge has spoken differently, but we also see that the judge has not really spoken substantively. The judge mainly said, I cannot sit on the legislator's chair. Legislation that is still in the making, I can't say anything about that. As for the location-specific data that have been in the KNMI's app for some time now, that is not urgent. So I can't say anything like that in summary judgment. So where our disappointment lies mainly is that there was actually no substantive ruling. And so we have to consider, how do we have to get a ruling on the substance in order to get clarity, what is actually in that law.

But then you're mainly concerned with the fact that KNMI can give local weather forecasts with its app, which is what you do?

Yes exactly. Look, KNMI, and that's kind of the crux of it, does that as part of its public task. And we recognize that too, KNMI's public task is a general message to society and warning the public about extreme weather. We think that's also very important, we certainly need KNMI to be able to do that as well. But that doesn't mean you have to put everyday weather at the zip code level in an app, which means you're competing with the market. That's just not what KNMI is for. That is actually, so to speak, where our difference of opinion with KNMI lies. Instead, we would much rather work with KNMI to say, how can we work together to create the best possible warning for Dutch citizens and spread this as widely as possible throughout society.

But what will be your next steps then?

Well, well, we will, so to speak, also coordinate with the fellow weather companies as to what we want to do with this. There are obviously a number of routes, we could look at, this is an interlocutory appeal. Yes, should we still ask the judge to look at this in a different way. Or, yes, we should also call on politicians to take a good look at this. Do we really want KNMI to spend taxpayers' money on activities that the market can perform, and perform very well? And do we find it logical that a government installation competes with the market?

Still, I then also think, in the end, wasn't it then a pretty stupid move to start these summary proceedings, because that has all been free advertising for KNMI's new app. And that app is also high on the app lists right now.

That's for sure, fortunately it has already dropped a bit, but yes, that's always a consideration, of course. If you start summary proceedings, in our case there is also a piece of publicity around it. We didn't choose that ourselves. But well, at the end of the day we also have to be clear about why we are doing something like this. So we feel it is also our responsibility to explain this to the media. But yes, I do expect a bottle of wine from KNMI for this good campaign that we have undertaken.
