Consumer-impact summary
[edit | edit source]User freedom
[edit | edit source]SK hynix SSDs are sold in retail packaging bearing the following notice: [2]
IMPORTANT - READ CAREFULLY BEFORE OPENING By breaking this seal, you are accepting SK hynix's terms and conditions enclosed in the box which includes, among others, ARBITRATION CLAUSE, LIMITED WARRANTY and RETURN POLICY and the terms of the license agreement at http://ssd.skhynix.com/ssd_terms_english.html. If you do not agree with the terms above, please return the product within 30 days of your purchase.
The terms cannot be read before the product is opened, and the notice offers rejection only via return within 30 days of purchase. The published terms additionally waive participation in class or representative actions and purport to be modifiable by the company at any time without notice.[3][4]
Business model
[edit | edit source]The enclosed terms exclude liability for data loss and recovery costs, cap total liability at the product's purchase price, and limit legal claims to one year from purchase.[5] Where replacement stock is unavailable, warranty claims may be settled by refund of the lower of the original purchase price or fair market value, which during storage shortages has left buyers unable to purchase an equivalent replacement.[6]
